These Terms Explain How Orders Work. They Do Not Exclude Any Mandatory Right Under The Consumer Protection Act, The Electronic Communications And Transactions Act Or Other Applicable South African Law.

By using this website, creating an account, submitting artwork, requesting a quotation or placing an order, you agree to these Terms to the extent permitted by law. If you place an order for another person or organisation, you confirm that you are authorised to act for them.
1. About AGP and These Terms
“AGP”, “we”, “us” and “our” refer to Awesome Goodies & Prints (Pty) Ltd. “You” and “customer” refer to the person or entity using the website or ordering goods or services.
These Terms apply to this website, WooCommerce orders, direct orders, quotations and related printing services. A written quotation, product page, artwork approval or campaign-specific term may add to these Terms. If documents conflict, mandatory law applies first, followed by the specifically accepted quotation or written order terms, then these general Terms.
2. Eligibility, Orders and Contract Formation
You must have legal capacity to enter into the transaction. If you are under 18, a parent or legal guardian must place or approve the order.
Products placed in a cart are not reserved. An automated order acknowledgement confirms receipt of your request but does not necessarily mean that custom production has been accepted. The order is accepted when AGP confirms it, begins production, dispatches the goods or otherwise expressly accepts it.
We may request clarification, usable artwork, proof approval, stock substitution consent or additional payment before accepting or producing an order. We may decline or cancel an order for a lawful reason, including unavailable stock, an obvious pricing error, suspected fraud, prohibited artwork or inability to produce the requested result. If we cancel after receiving payment, amounts due will be refunded in accordance with applicable law.
3. Product Information, Availability and Pricing
We aim to display accurate descriptions, images, specifications and prices. Images are illustrative: screens, lighting, materials, print methods and manufacturing batches can cause reasonable differences in colour, texture, size or finish.
Prices are shown in South African rand and include VAT where indicated or legally required. Delivery, artwork, rush production, special packaging and other separately identified charges may be added before checkout or in a quotation. The total payable will be displayed or agreed before the order is confirmed.
Stock and production capacity can change. If a selected blank product becomes unavailable, we will contact you about a suitable alternative, delay or refund. We will not substitute a materially different product without approval.
If a displayed price or description contains an obvious error, we may correct it before accepting the order. Nothing in this clause permits misleading pricing or removes rights granted by the CPA.
4. Payment, Fraud Prevention and Ownership
Available payment methods are shown at checkout and may be provided by third-party payment gateways. Production normally starts only after cleared payment, required information and usable artwork have been received.
You authorise us and our payment, fraud-prevention and delivery providers to process information reasonably needed to complete and protect the transaction, subject to our Privacy Policy and applicable law. We do not control a payment provider’s separate service availability or bank processing times.
Ownership of physical goods passes as provided by law and the agreed transaction. Risk in delivery is allocated in accordance with applicable consumer law and the chosen delivery arrangement; this clause does not transfer supplier risk to a consumer where the law prohibits it.
5. Customer Artwork, Copyright and Trade Marks
You retain whatever rights you lawfully hold in artwork you submit. By uploading or sending content, you grant AGP a non-exclusive licence to store, copy, resize, convert, arrange and reproduce it only as reasonably necessary to quote, proof, produce, quality-check, fulfil and support your order.
You confirm that you own the content or have all permissions required to reproduce it on the ordered products. This includes photographs, logos, characters, trade marks, fonts, music-related imagery, sports branding and artwork created by another person.
Do not submit content that is unlawful, infringing, defamatory, hateful, threatening, exploitative, deceptive, obscene, invasive of privacy or otherwise prohibited by law. We may refuse, pause or cancel production where we reasonably believe content is unlawful or infringes another person’s rights.
To the extent permitted by law, you are responsible for substantiated third-party claims arising from content you supplied without the required authority. We will not use this clause to avoid responsibility for AGP’s own unlawful conduct, negligence or breach.
6. AGP-Created Designs and Production Files
Unless otherwise agreed in writing, purchasing a printed item or design service does not automatically transfer copyright in original artwork, templates, mock-ups, layouts, production files, digitised embroidery files or design elements created by AGP.
Your paid order includes the finished physical product and the usage rights expressly stated in the quotation or written agreement. Editable or production-ready source files are supplied only where specifically included. Customer-owned logos and supplied artwork remain subject to the customer’s underlying rights.
7. Artwork Quality, Proofs and Customer Approval
You are responsible for checking names, spelling, dates, quantities, garment sizes, colours, dimensions, placement and other custom details. Supply the highest-quality original file available and follow the Artwork Guide.
A digital proof is an approximation, not a guarantee of exact physical colour, scale or texture. Where approval is requested, production may rely on that approval. Errors visible in an approved proof or supplied exactly as entered by the customer are not production defects, unless AGP caused or failed to reproduce the approved information correctly.
We may flag obvious problems, but we do not undertake to proofread, verify ownership, inspect every design element or improve every file. Enlarging a small image does not create missing detail.
8. Personalisation and Reasonable Production Variation
Custom printing involves physical materials and processes. Small, reasonable variations may occur between batches or individual items in colour, position, dimensions, texture, coating, garment construction and finish. A variation is assessed in context and does not excuse a product that fails the quality requirements of the CPA.
DTF and UV-DTF transfers must be inspected before application and used with the supplied instructions. Results can be affected by heat, time, pressure, garment composition, coatings, surface texture, cleaning, alignment and care. Application damage caused by unsuitable equipment, surfaces or use contrary to instructions is not a manufacturing defect.
9. Changes, Cancellations and Production Times
Contact us immediately if you need to change or cancel an order. We will try to assist before production starts, but a change may affect price and completion time.
Once personalised or made-to-order production has started, changes and change-of-mind cancellation are generally unavailable because the goods are made specifically for you. Reasonable costs already incurred may apply where permitted by law. This does not affect rights relating to defective, unsafe or incorrectly supplied goods.
Production estimates begin only after payment, all required choices, usable artwork and any required approval have been received. Business days exclude weekends and South African public holidays. Rush deadlines apply only when expressly confirmed in writing.
10. Collection, Delivery and Risk
Courier transit time is separate from production time. Delivery dates are estimates unless expressly guaranteed in writing. Tracking events and delivery scans are provided by the courier.
You must provide a complete, accurate address and a reachable recipient. Re-delivery, address correction, storage or return-to-sender charges caused by incorrect customer details, refusal or failure to collect may be payable by you, unless the failure was caused by AGP or the courier.
Inspect parcels promptly. Keep packaging and photograph damage, missing items or incorrect goods. Contact us with the order number so we can investigate. Where the CPA or other law places delivery risk on the supplier, these Terms do not change that allocation.
11. Returns, Defects, Refunds and Cooling-off Rights
Returns and remedies are governed by our Refund & Returns Policy, which forms part of these Terms.
Personalised or specification-made goods are excluded from the ordinary ECTA cooling-off right, but this does not remove rights where goods are defective, unsafe, incorrectly supplied or otherwise fail to meet mandatory legal standards. Eligible standard online goods may have a statutory cooling-off right, subject to the Act’s conditions and exceptions.
12. Care, Compatibility and Intended Use
Follow supplied washing, pressing, surface-preparation, application and care instructions. Product life depends on the material, print method, use and care. Do not use decorative products, drinkware, transfers or printed items for a purpose not stated as suitable.
You are responsible for checking product measurements, garment size guides and compatibility with your intended equipment or surface before customisation or application. Ask us before ordering if suitability is uncertain.
13. Accounts, Reviews and Website Use
Keep account and password details confidential and tell us promptly about suspected unauthorised use. Information you provide must be accurate and current.
You may not misuse the website, introduce malicious code, scrape or copy it unlawfully, interfere with security, attempt unauthorised access, submit fraudulent orders or use the service to violate another person’s rights.
Reviews and other submitted content must reflect genuine experience and must not be unlawful or misleading. You grant us permission to display a submitted review with the name or identifier you chose, subject to privacy law. We may moderate unlawful, abusive, irrelevant or fraudulent content, but will not suppress a genuine negative review merely because it is critical.
14. Promotions, Coupons and Gift Cards
Promotions may have stated dates, eligible products, stock limits and redemption rules. Unless expressly allowed, offers cannot be combined, exchanged for cash or applied retrospectively. We may correct misuse or cancel fraudulently obtained discounts, subject to applicable law.
Gift-card or voucher validity, redemption and refund rights are governed by the CPA and the specific terms disclosed when issued. Promotional free items may need to be returned with the qualifying purchase if that purchase is lawfully returned.
15. Privacy and Communications
We process personal information to manage enquiries, payments, production, delivery, support, fraud prevention and legal obligations, as explained in our Privacy Policy. Transactional messages about an order are not marketing messages.
Where marketing consent is required, you may withdraw it using the provided option or by contacting us. Withdrawing marketing consent does not stop communications necessary to complete an existing order.
16. Responsibility, Website Availability and Liability
We take reasonable care in providing the website, goods and services. The website may occasionally be unavailable for maintenance, hosting, security or circumstances outside reasonable control. Product designer previews, third-party plugins, courier tracking and payment services may depend on external providers.
To the maximum extent permitted by law, neither party is responsible for indirect or consequential loss that was not reasonably foreseeable when the agreement was made. No limitation in these Terms excludes liability that cannot lawfully be excluded, including mandatory CPA remedies, or liability for fraud, gross negligence or wilful misconduct.
If circumstances beyond reasonable control delay performance, we will communicate and take reasonable steps to reduce the effect. Payment obligations for goods already properly supplied remain due. Statutory rights relating to non-performance or delayed performance remain unaffected.
17. Business, School, Team, Reseller and Bulk Orders
Quoted or account orders may include deposits, minimum quantities, staged approvals, repeat-order specifications, special procurement, delivery schedules or credit terms. Those accepted written terms apply in addition to these Terms.
You are responsible for consolidating authorised instructions from your organisation. Changes from different representatives may delay production. Samples and previous orders are useful references but cannot guarantee that later manufacturing batches will be identical.
Whether the CPA applies to a juristic person can depend on the transaction and the applicable statutory threshold. Nothing here claims to remove protection where the Act applies.
18. Questions, Complaints and Dispute Resolution
Please contact AGP first so we can investigate and try to resolve the matter promptly. Include your order number, a clear explanation and supporting photographs or documents.

If a qualifying consumer complaint cannot be resolved directly, you may approach an applicable consumer ombud, provincial consumer authority or the National Consumer Commission, or use any other lawful remedy.
19. Governing Law, Severability and Changes
These Terms are governed by the laws of the Republic of South Africa. Any dispute will be dealt with by a court or authorised consumer forum having jurisdiction under applicable law.
If a provision is unlawful or unenforceable, it will be limited or severed only to the extent necessary, without invalidating the remaining provisions. A failure to enforce a provision once is not a permanent waiver.
We may update these Terms for future use of the website or future orders. The version accepted when an order is placed will normally apply to that order, subject always to mandatory legal rights.
